1. GENERAL INFORMATION

In compliance with Article 10 of Law 34/2002, of 11th July, on Information Society Services and Electronic Commerce (LSSICE), we provide you with the "general information," which includes the identifying details of the entity owning this website and information related to the price of products/services offered through it:

2. INTELLECTUAL PROPERTY 

2.1. Website content

The contents of the website (URL), including texts, images, graphic design, source code, logos, brands, etc., are the exclusive property of Cortana and are protected by Intellectual and Industrial Property regulations. Therefore, reproduction, modification, distribution, or manipulation is prohibited.

Cortana holds all intellectual, industrial, and similar property rights corresponding to the website. Additionally, all rights over any content, services, or elements of its property incorporated into the website are reserved for Cortana or any companies that form or may form the Cortana group of companies, including, but not limited to:

  • Elements forming the visual appearance, graphic image, and other sensory stimuli of the web pages that make up the website: navigation architecture, web page source codes, images, recordings, computer programs, databases, technology, logos, and distinctive signs.
  • Cortana reserves the right to update, modify or delete any information contained on its website, as well as its configuration, performance, or general conditions, at any time and without prior notice. Cortana does not guarantee the absence of interruptions or errors in accessing the website and assumes no responsibility for technical problems or failures occurring during Internet connection.
  • Cortana also does not guarantee the absence of viruses or other elements that may cause alterations in your computer system (software and hardware) or electronic documents and files stored in your computer system, and thus excludes any liability for damages that may occur to the user’s computer system, electronic documents, or files.


2.2. Reservation of rights

2.2.1. The user agrees not to remove, suppress, alter, manipulate, or in any way modify any notes, legends, indications, or symbols that Cortana or legitimate right holders incorporate into their properties regarding intellectual or industrial property (such as copyright, ©, ®, and ™, etc.) or any technical protection or identification devices that the contents may contain (such as watermarks, fingerprints, etc.).

2.2.2. Cortana authorises users to access and navigate the website, using the services and viewing the content incorporated therein. Access, viewing, and downloading of content or services will always be strictly personal and non-commercial.

2.2.3. Cortana reserves all property rights, including, but not limited to, all intellectual and industrial property rights it holds over them. Cortana does not grant any other licence or authorisation of use to the user over its property other than what is detailed in this clause.


2.3. Link Licence 

2.3.1. Any third-party link to this website must be to its main or entry page. Users and anyone planning to establish a link between their web page and the website must comply with the following conditions. Any other link request not stipulated in this clause requires Cortana's prior written acceptance.

2.3.2. The user may not reproduce or imitate, fully or partially, the website's content or its graphical appearance (“look and feel”), nor create frames or inline links (“link online”) of Cortana’s web pages. They may not create a “browser,” frame, environment, or navigation bar over the website pages.

2.3.3. The user may not make false, inaccurate, incorrect, or denigratory statements about the website, Cortana, or any of Cortana's properties and, in particular, must not declare or imply that Cortana collaborates or is a partner, or that it has in any way supervised or assumed the content or services offered or made available on the web page where the link is established.

2.3.4. The web page where the link is established must not contain any trademark, trade name, establishment sign, denomination, logo, slogan, or other distinctive signs belonging to Cortana, except those forming part of the link itself or those previously licensed in writing by Cortana.

2.3.5. The web page where the link is established must not contain information or content that is illegal, contrary to morality, generally accepted good customs, and public order, nor contain content or services.


2.4. Legal actions

Cortana reserves the right to take appropriate legal action against anyone who breaches the following prohibitions. It is expressly prohibited:

2.4.1. To use any content or services for illegal purposes or effects, prohibited in this Legal Notice, harmful to the rights and interests of third parties, or that may or could damage, disable, overload, deteriorate or impede the normal use of services, computer equipment, documents, files, or any content stored on any Cortana computer equipment.

2.4.2. To use content or services protected by any intellectual or industrial property right belonging to the entity or third parties without having previously obtained the necessary authorisation from their holders for the use made or intended to be made.

2.4.3. To reproduce, copy, distribute, communicate, transform or modify the content unless authorised by the holder of the corresponding rights or legally permitted.

2.4.4. To introduce viruses or other physical or electronic elements that may or could damage or impede the normal functioning of Cortana’s network, system, or computer equipment (hardware and software) or those of third parties, or that may damage electronic documents and files stored on such computer equipment.

2.4.5. To obtain or even attempt to obtain content using means or procedures different from those that, as the case may be, have been made available for this purpose, generally used on the Internet, provided they do not entail a risk of damage or disablement of the website, services, or content.

Cortana excludes, to the fullest extent permitted by law, any liability for damages of any kind that may result from the transmission, dissemination, storage, availability, reception, acquisition, or access to content, and in particular, although not exclusively, for damages that may be caused.


3. GENERAL CONDITIONS OF ELECTRONIC SALES

3.1. Scope of application

These General Conditions aim to govern the purchase of products and services made remotely via the Internet from the website managed by the company.

These General Sales Conditions will apply to all deliveries made by TRANSCORTANA, S.L. or on behalf of its website www.cortana.es, unless different conditions are established in specific offers.

 

3.2. Acceptance of general sales conditions

3.2.1. The Customer, via email confirmation of their purchase order, unconditionally accepts and agrees to abide by their relations with the online store after making the purchase. The general and payment conditions are those indicated in this contract, declaring that the Customer has read and accepted all the information provided under the aforementioned regulations, and will also consider that the online store is only bound by the conditions previously established in writing.

3.2.2. The sale and supply of products by Cortana, its divisions, subsidiaries, and affiliated companies will be subject to these general contracting conditions (the “Conditions,” and the contract between the Customer and Cortana governed by these Conditions will be collectively referred to as the “contract”), without applying any other conditions different or additional that may be contained in any purchase order, document, or other communication (the “order”) and that modify, alter or contradict the terms of this contract. No term or condition included in any other document from the Customer, such as orders or confirmations, will alter or supplement the terms of this contract, even if Cortana has not objected to such additional or conflicting terms.

 

3.3. Customer obligations

3.3.1. The General Sales Conditions must be read online by customers visiting the page and the virtual store before confirming their purchases. Therefore, sending the order confirmation implies absolute knowledge of these General Sales Conditions and their total acceptance. The Customer agrees, once the online purchase process is completed, to print and keep these General Sales Conditions, already read and accepted during the purchase process, to fully comply with Spanish law.


3.3.2. The Customer will be solely responsible, exonerating Cortana to the extent appropriate, for damages resulting from improper use, storage, conservation, or handling of the products; in particular, when they have not followed the indications, warnings, or instructions provided by Cortana in this regard.


3.3.3. Any information about the products (including, for example, instructions and technical or other advice, advertising indications, technical specifications, their functions, their classification for export and import controls, their uses, or compliance with legal or other requirements) will be provided by Cortana “as is.” Cortana assumes no responsibility or warranty for it. This information is not part of the product’s properties. Cortana does not make any representation or warranty regarding the accuracy or completeness of product information and assumes no responsibility for any product information. Cortana recommends that the Customer validate any product information before any use or action based on such information. All product information is subject to change without notice. Cortana assumes no responsibility for typographical or other errors or omissions in product information.


3.4. How to place an order through the online store? 

The Customer will make the purchase of the products, available as described online in the respective descriptive and technical sheets, at the indicated price. Before confirming the purchase, the unit cost of each preselected product and the total cost will be summarised for the Customer. Upon confirming the purchase, and at the end of the transaction, the Customer will receive information about the number, date, total amount of the order, and the shipping number or key for tracking and monitoring its status at all times.


3.5. Payments

3.5.1. Payment for purchased products and related shipping costs must be made by the Customer upon order confirmation via PayPal, credit card, or debit card.

3.5.2. If the payment is not credited by financial entities, Cortana will not consider the order.

3.5.3. In case of total or partial non-payment of any product order by the due date, according to Law 3/2004 of December 29, establishing measures against late payment in commercial transactions, Article 5, the overdue amount will accrue the corresponding late interest without the need for a reminder or notice from Cortana. The Customer will also bear the return costs incurred by Cortana. Additionally, Cortana may suspend or cancel pending product deliveries until the overdue and payable order is paid, or request advance payment for any new order.


3.6. Product availability and delivery

3.6.1. Cortana's warehouse will be considered the dispatch location for all transactions. The approximate delivery date will occur once the order is dispatched.

3.6.2. Delivery times are approximate, and delays will not be grounds for claims for damages. Shipments of prêt-à-porter and tulle collection items will be delivered within approximately five (1) to ten (5) business days. Wedding dress collections are subject to custom orders and different delivery times, with delivery periods of approximately six (6) months, subject to variation.

3.6.3. Cortana will not be responsible for delays in delivery beyond its control. If product supply is delayed due to an event outside our control, we will contact the Customer as soon as possible to inform them and take measures to minimise the delay's impact. We will not be responsible for delays caused by such events.


3.7. Product transportation 

3.7.1. The product will only be shipped once the corresponding shipping costs have been paid and charged to the purchase invoice.

3.7.2. The Customer cannot choose or indicate the means of transportation unless Cortana decides to provide this option.  

3.7.3. After the order leaves Cortana's warehouses, the Customer will receive an informational email with a tracking number from the carrier.

3.7.4. Shipping costs will be established at the time of purchase completion.

3.7.5. The Customer must consult the shipping rate, being solely responsible and exonerating Cortana from any claims. If the Customer does not consult the shipping rate, Cortana will not be responsible.

3.7.6 Cortana's online store ships to almost all countries(*). Shipping costs may vary depending on the destination country.

(*) Cortana does not ship to the following areas of EU countries: Ceuta, Melilla, or Canary Islands (Spain), Helgoland Island and Büsingen city (Germany), Faroe Islands and Greenland (Denmark), Aland Islands (Finland), Mount Athos (Greece), San Marino, Livigno, Campione, or Lugano Lake areas (Italy), Channel Islands and Gibraltar (UK).


3.8. Contract between Cortana and the Customer 

3.8.1. Cortana will accept the Customer's order upon successful payment, establishing a contract between Cortana and the Customer.

3.8.2. An order is not final until accepted by Cortana's online store.

3.8.3. Placing an order in Cortana's online store implies the Customer's acceptance of Cortana's legal sale conditions. No stipulation made by the Customer can differ from Cortana's online store conditions unless expressly accepted in advance and in writing by Cortana.

3.8.4. The Customer is responsible for verifying that the product shipped by Cortana matches the order and has no apparent damage. If the product does not match the order or has external damage, the Customer must reject the goods and contact Cortana's Customer Service at shoponline@cortana.es

3.8.5. Product rejection by the Customer is subject to Cortana's return policy. The Customer must inform Cortana of any issues within 14 business days after receiving the order.

3.8.6. Cortana will be exempt from liability for damages caused by product defects, except when expressly required by applicable mandatory law, such as in cases of death or bodily injury. Cortana will not be responsible for indirect damages, lost profits, production losses, or profit losses.

3.8.7. If Cortana is required to assume liability for damages suffered by the Customer, it will be limited to an amount equivalent to the order price of the product causing the damage, unless a higher limit is imposed by applicable mandatory law.


3.9. Prices

3.9.1. Published prices will be valid except in the case of typographical errors or lack of stock. Packaging is included in the product price unless otherwise indicated.

3.9.4. Cortana reserves the right to modify product prices at any time. Price increases will not affect ongoing product orders previously accepted by Cortana. If the Customer places an order with an incorrect price, Cortana will inform the Customer of the correct price. If the Customer accepts the new price, Cortana will process the order upon the Customer's express confirmation within two (2) days.

3.9.5 Published prices on the website will correspond to the currency of each country. 

3.9.6. Customers residing in countries with a currency other than the euro should note that financial entities managing the payment methods enabled by the online store will always use the equivalent for their payment.

 

3.10. Payment conditions
Products and services will be paid via PayPal or credit/debit card, provided these payment systems are implemented, operational, and accessible on the website. The online store will ensure compliance with European legislation by implementing necessary security measures for banking data.


3.11. Data protection (LOPD)
According to personal data protection regulations, the online store will inform users of the existence of a personal data file created for information, training, and commercial promotion of online store services. Users will be informed of their right to access, rectify, cancel, and oppose personal data in the file. The online store commits to maintaining the confidentiality and security of personal data, adopting necessary measures to prevent alteration, loss, unauthorised processing, or access, considering the state of technology.


3.12. Shipping policies
3.12.1. The online store will not ship any products until the Sales Department has verified full payment.

3.12.2. Delivery is considered complete when the online store has made the products available to the Customer, and the Customer has accepted the delivery receipt document. The Customer must verify the products upon receipt and report any justified claims via the web's email.

3.12.3. Delivery times indicated by the online store aim to meet them as much as possible. However, delivery delays will not justify order cancellation or compensation. Any penalty clause for delay introduced by the Customer in their order is void.

3.12.4. The online store will strive to ship products using its chosen system. However, in case of transportation failures beyond the online store's control, it reserves the right to resend them by any necessary means to meet delivery times.

3.12.5. Delivery times are indicated for each product but may be subject to availability or stock shortages.

3.12.6. Any delivery date modification by the Customer must be expressly accepted by Cortana.

3.12.7. Cortana reserves the right to interrupt the delivery of ordered goods without liability in case of non-payment by the Customer or financial insolvency.

3.12.8. Any delivery date provided by Cortana is an estimate, depending on timely receipt of supplies. Cortana is not responsible for delivery delays. Cortana reserves the right to make partial deliveries, which the Customer must accept and pay for delivered products. Delivery delays of any part of an order do not entitle the Customer to cancel other deliveries.


3.13. Claims and returns
3.13.1. Any claim for damaged goods must be reported within 14 calendar days in Spain following receipt of the shipment to process the claim.

3.13.2. Any claim for missing or incorrect shipments must be notified within a maximum of 14 calendar days in Spain from the shipment date. The Customer has no right to request a return if they have not communicated the error/defect via email to Customer Service shoponline@cortana.es within 14 calendar days in Spain after receiving the order.

3.13.3. In case of return due to shipping error or causes attributable to Cortana, shipments on a cash-on-delivery basis will not be accepted. Cortana will handle the necessary arrangements to retrieve the incorrect merchandise and replace it with the correct one.

3.13.4. Products supplied by Cortana are intended exclusively for the uses specified by the manufacturer. The Customer is solely responsible for the consequences of improper use of the supplied products.

3.13.5. Claims for damages made by the Customer are expressly excluded unless there is gross negligence or willful misconduct by Cortana.

3.13.6. The Customer's acceptance of the quantity of products delivered in relation to an order will be confirmed by signing the corresponding delivery note at the time of delivery. If the Customer does not make a claim regarding any potential quantity or quality defect within the stipulated time after receiving the products, Cortana will not assume any responsibility.

3.13.7. The Customer must examine the products as soon as possible after receipt to verify their conformity with the type of product ordered and the absence of apparent or hidden defects. In any case, after receiving the products, the Customer has a period of fourteen (14) calendar days to claim any difference in the type of products delivered compared to those ordered or the existence of an apparent defect.

3.13.8. In the event of a return, the products must be in the same condition as originally delivered, new, unused, with all tags intact, and with their respective accessories.

3.13.9.  Cortana will not accept exchanges or returns due to errors made by the Customer when selecting the size or colour of the product.

3.13.10. In cases where a refund to the Customer is appropriate, Cortana will process the refunds promptly in the same manner as the purchase was made, using the same provider (PayPal, Visa, MasterCard, etc.). Cortana will not be responsible for the processing times of these providers.

3.14.11. The costs of returning the order will be borne by the Customer, deducted from the refunded amount after the return is accepted.


3.15. Guarantees

Cortana guarantees the quality and reliability of the products, which ends when the merchandise has been modified, manipulated, or disassembled, as any modification is understood to be made under the Customer's responsibility.


3.16. Final clarifications

To the extent permitted by applicable laws, neither Cortana, nor its employees, nor its agents will be responsible, and the Customer will not have the right to claim for any indirect, special, occasional, or consequential damage, nor for any emergent damage or lost profits that may be caused; for example, they will not be responsible for reductions in profits or income, loss of data, interruptions in use, reworking, additional manufacturing costs, damage to reputation, or loss of Customers. To the extent permitted by applicable laws, and only in case direct damage is caused, Cortana will indemnify the Customer with a sum that can never exceed the original price of the product in question.

4. SIZING, FIT AND COLOUR INFORMATION

4.1. Size guide

The Customer can consult Cortana's size conversion chart by clicking on "Size Guide," located above the menu when selecting the size on the product information page. The size guide corresponds to body-based measurements and not to the measurements of each product. The size of a product may vary depending on the model due to the cut, fit, or material it is made from.

If the Customer wishes to consult the specific sizing of an item, they can contact Customer Service via email at shoponline@cortana.es.


4.2. Colour and texture

Cortana cannot guarantee the complete fidelity between the digital representation of the items on the web and their real image on various electronic devices, as these devices can significantly alter the appearance of the product. In particular, there may be minimal colour variations between devices due to their technical characteristics. Cortana will not assume responsibility for minor discrepancies that may arise in this process.
